Overview

The historical time of the 21st century seems to be the time of complexity (Stephen Hawking). The complexity of reality is imposed as a given of knowledge, including knowledge of law. It requires multiple perspectives of approach, without one of them being infallible. In this context, the relationship between science and philosophy has evolved spectacularly. From the positivist moment of the rejection of philosophy by science, with resistant strands even today, philosophy strongly affirms its hypothesis of a constitutive dimension of science, any scientific knowledge being, first of all, a way of understanding the world (D. Bohm). Philosophy cannot invade the legal world or impose itself in a homogeneous, monolithic way as a theoretical block. This approach would be a legal nightmare and would provoke strong and legitimate resistance. The natural aspiration of philosophy towards wholeness and totality (Plato) in relation to law is manifested by proposing various configurations of symbiosis in which law strongly asserts its specificity. Then the geometry of the philosophy-law connections becomes decisive.My book proposes for analysis several hypotheses of the philosophy of law, a certain theoretical architecture capable of realizations and enrichments depending on different contexts.
