The ironic thing about circumstantial evidence is that you know it, I know it, the judge knows it, the jury knows it, but no one can prove it. All the evidence in the rape and murder of Cheryl Ann Bailey, a capital crime, is purely circumstantial. The only exception is the identification of one assailant by the other assailant.
